Greene to Argue 3 Points Before the Court

Mark Greene v. Sherril Huff, Director of Elections and Julie Wise, Deputy Director of Elections

In regards to this effort in eventually filing a Complaint to the Court and an injunction request for a new vote count for the Federal Way City Council, Position 1 Election, I will argue at least 3 points to try to reverse the vote count or to have a new election for the regular term only:

1.)  It's federally unconstitutional to tie two separate terms together in one election, as the Position 1 election included the short term from the current Position 1 term, and the regular term that extends from the years 2016 to 2020.  The Nov. 3rd election should only count for the short term, since that is the preceding term of the two separate terms.  Each election (short and regular terms) should have been listed separately on the ballot, and therefore a new election should be held for the regular term.

2.)  Given that my photograph inexplicably disappeared from the King County Elections Dept. website for several days in September of 2015, that distraction questions the accountability of the Department in regards to the Position 1 election, and at the very least a re-count of votes for this particular position is called for to ensure that the vote count was conducted competently.

3.)  The election machines used by King County for vote counting come from a company which has a controversial history and have been deemed not reliable by some election administration experts, therefore all elections in the county in which a second-place candidate received at least 45% of the vote, or a measure which has a differential of less than 10 percentage points, should be recounted by hand to ensure the reliability of the election machines and the integrity of the overall election.

There may or may not be other points to the Complaint written besides the aforementioned 3, as I am addressing this whole election matter and court business this week, and plan to have my Complaint filed and Summons issued before the business week is over.
